Did you know that only one state (Oregon) requires lawyers to carry malpractice insurance? Only six states (Delaware, Illinois, Michigan, Nebraska, North Carolina, and Virginia) require attorneys to disclose whether they have malpractice insurance. Only five states (Alaska, New Hampshire, Ohio, and South Dakota) require that a lawyer tell their clients and potential clients if they do not have a specified minimum level of malpractice insurance.

How do you know if your lawyer, or any other professional, has malpractice insurance? In New Jersey the only way is to ask. This is a reasonable question and should be asked of every professional you hire or are considering hiring. And yes, I do carry professional liability insurance in an adequate amount based on my excellent insurance agent's recommendation (and yes, my insurance agent also carries professional liability insurance).
